Video game music OK to use in a YouTube video?

Since the quality of YouTube videos are better now, I'd like to re-upload one of my videos again to see if it will look better. Instead of the crappy random noise I used the first time, I'd like to use music from a Commodore 64 game. Any problem doing that as long as I say where the music is from in the description?

There is virtually no worry about infringing on copyrighted video game music. I have never had it happen to me (I have about 50 videos up, most are about video games) nor have I heard anything about people getting shut down for it either. But I've heard about many, MANY cases involving band/label/lyrical music. In my opinion, as long as you don't put Metallica or Justin Bieber in your video, you will be just fine. And besides, why would you want band music in a game video anyway?

The courts do not recognize the concept of abandonware, in spite of the many websites that exist promoting the concept. The term of copyright for works for hire (works done by an employee for an employer, not individual copyright) are 95 years from publication or 120 years from creation whichever is shorter (anonymous works, pseudonymous works, or works made for hire, published since 1978) so technically most of the 2600 ROMs that most of us here download for our emulators would still be covered. Yep, we're all breaking the law whenever we boot up a ROM in Stella or rip a ROM and turn it into a file. Don't forget, when companies disappear from the scene, they don't just terminate. Their properties are usually acquired by others and they could enforce their rights at any time.

I wouldn't put it past Youtube to try though, i have seen them do allot of things that does not make since.

 

If anyone raises a stink over the video no matter if its legal they can and will pull the video or disable the audio.

 

I have seen all to many times where a video had music playing in the background ( could be from a TV or a radio in the background or the music was added to the video but with the original works) but have the original works (talking, diffrent sounds that has nothing to do with the music playing in the background) in the audio mainly covering the music and still have the audio disabled.

 

That attitude alone made me shy away from Youtube and find another video host. Google knows how to destroy something good, what Youtube use to be and be about.

 

There is a fair use law but they do not abide by it because they do not see it as a law.

 

But i have seen many go untouched and some will remain that way until youtube goes under or the user removes the video.
