This thread is by far the wildest, most out-of-this-world bizarrely entertaining one I've followed in a while.  It's got everything, absurdity, tragedy, hypocrisy, humor, you name it, it's in here!  :-D  What could possibly come next?  :rolling:

Has anyone posted this 2008 NYT article about RWB and how zombie brands work? The product doesn't have to be the same, but the tug of familiarity is supposed to be effective for bringing back old fans.

Video Game Bull S***? Or does "BS" stand for something else here? Might be a bad name for any serious podcast unless, you are doing parody or "bad game" reviews AVGN style.

 

And yeah, I seen the Nintendo logo at the bottom of the poster. Tons of fans and homebrewers do this across all systems, and it is bad practice IMO. It's one thing to borrow sprite art when doing fan sites or articles, but don't place any official looking logo on homebrew games, including Seal of Quality parodies where you would need to examine with a magnifying glass to get the joke.

 

People need to stop using the logos and stuff of other companies but I digress. It just opens yourself up to problems.

 

 

So they say it's an NES cart but it's NOT for the NES.  They're dumber than I originally thought.  Of course those hypocrites are fine with others using the Nintendo logo and supporting those who use the Nintendo logo.  They're fine with whatever they say is okay; they're contradictory and hypocritical jerks.

Dumb indeed. Maybe it just has 72 pins and interfaces with flying saucers for all we know... :lolblue:

Referencing the responses from Coleco Toys in the comments of this video, I can't believe Chris is still fighting this, even after he took his gripes to Nintendo and Namco and they said they did not want to hurt their relationship with the community or get involved in an intellectual property case (according to colecovision.dk news).

Someone in the comments said this, which I think is interesting.

The DMCA cannot be used for trademark enforcement. It is specifically for copyright. Filing a bogus DMCA claim falls "under penalty of perjury."

 

True? I have no idea. 

 

Then this ... I've edited it a little bit to just show the principals and not the peanut gallery, but no important context was removed. I think it's smart to quote stuff like this because it has a way of disappearing from the internet. "Coleco" Cardillo is so far out of its depth it's not even funny. 

 

At about the 15 min mark you state "Don't go after the fan group because they are not producing the product." In several other spots you state that you understand going after the producers of infringing works. What you weren't told here is that the owner of the 'fan' page IS THE PRODUCER for OpCode games and was or is a producer for another well known developer also infringing on the marks. The owner of the page has a significant background in producing video games. The page is merely a conduit to market his products labeled a 'fan' page. Coleco IS making projects as we speak, and we would be more than happy to discuss this with you. A bit of constructive criticism: it would be a good idea to contact the company to gather both sides of a story prior to having a show to inform listeners. You do have our contact info.

Your side of the story is in the attached AtariAge thread in more than one response. Based on everything presented, in my opinion your attack has been too broad and not targeted appropriately. You cannot hold a fan page accountable for reporting on and/or showing pictures of products that exist, regardless of whether or not you think they infringe on your trademark (correctly or incorrectly). That is a bridge too far, regardless of who runs the page.

 
On that note, do you mind if someone set up a Pat the Punk fan club page. Then reprinted and sold your books? Or would that be unacceptable to you?
Coleco Holdings - do you own the copyright to old Colecovision games? If so, which games do you own the actual copyright to? Also: I produced and composed the book myself. Did you produce and put together the Colecovision games you speak of?
 
As you know, the developers made the games independently, then used the marks inappropriately. That is the point. The discussion here centers around the TM. You did do a good job explaining this in your show. This is not allowed, much the same way that your book improperly uses the Nintendo mark. Big no-no. If you recall, our team initially attempted to connect you with Barnes and Nobles. Legal compliance is costly and time consuming but assures consumers safe, quality products. We are obligated to consumers to deliver on a certain set of standards.
Pat has traditionally presented news is a less biased forum. We feel as though he did not have complete grasp of all the information available. We offered an open discussion with him.
So go after the producers of the trademark infringements, not the fan page. The fans are the people who might potentially buy a future licensed product.

I gave you a huge benefit of the doubt when it came to the Chameleon. Good luck with your convention.
Coleco Toys, his book is fair use.... he made a review book. thats like sayimg game stops game informer infringes... im sure game informer has deals but really game informer doesn't have to make deals to do reviews

We produce the fan page out of passion for the classic ColecoVision system.

Oh, c'mon, it IS funny! This whole scenario is just absurd beyond belief! And I haven't even posted about the latest INSANELY crazy stuff where "Coleco Toys" tried to edit the Coleco Industries wikipedia page making erroneous claims of "cyber bullying," editing out information about the Chameleon debacle, and thinking that somehow they can "control" the Coleco Wikipedia page!  Trust me, go look it up yourself on Wikipedia.  Just when you think this is all batshit crazy on a level that is hard to believe, it gets worse.  And the most amazing thing about all of this?  Cardillo and Coleco did it to themselves.  They could have *EASILY* avoided all of this by Coleco Holdings LLC going "Oops!  Sorry, let me retract those trademark claims" but now they have a well known retrogaming community personality with over 200k subscribers on their YouTube channel letting everyone know the true colors behind what's going on.

 

I guess I'm never going to see that retraction email now, am I?

Pretty much anyone that has purchased a home-brew game for the ColecoVision could consider themselves a "producer" for the next project.  

 

WTF Chris?  If TPR is such a big shot producer, then why would he shill for his competition on his FB page?

 

Oh that's right, it's a FAN PAGE.  So he probably listed games from everybody.

 

Way to go shutting that shit down.

More sad than funny. I don't think Cardillo even comprehends what he does and does not own. He doesn't own Coleco's history, he doesn't get to put factually inaccurate things on Wikipedia, and he's lost control of the narrative. Coleco is nothing but a funny little wannabe rapper, impotently bullying people he doesn't know over things he doesn't understand. I agree that everything done to his reputation thus far has been self-inflicted.

Pat deleted comments on the YouTube channel? That seems like more effort than our slacker friend would exert. Especially when COLECO HOLDINGS is saying all the dumb things. 

 

Maybe just maybe @ColecoVision_ (the underscore is silent) doesn't know what he's doing. 

 

BTW @ColecoVision_ just tweeted several times, "it's on like Donkey Kong." Adorbs.
