Atari SA doesn't seem to acknowledge the existence of anything beyond the 2600. Atari VCS backers are clamoring for 8-bit/5200, 7800, Lynx, and Jaguar games, but only get cookie-cutter replies. I'll bet if you were to wear one of my Cybermorph-themed t-shirts around Atari HQ, they'd be like, Que diable est-ce?! We'll never, never see Atari SA sell Jaguar-related merchandise, which is a big reason why I wanted to put some designs out there.

Well, this changes the discussion a bit.

Lots of new Atari-related designs back up on RedBubble, showing things like the Adventure bat, more joysticks, a screenshot of 2600 Berzerk, and an Adventure/Combat mash-up. I wonder if Atari SA will go back through for another strafing run.

 

I did a little reading (well, skimming) on fair use this morning, and the general rule of thumb seems to be if a work is transformative, then it's fair use. For example, if I made a design with a picture of Skylar and the text "Where did you learn to fly?" and that's it, then that would probably not fall under fair use. However, making something resembling a T-Griffon and framing it as a flight school, I'd think that would be a transformative, and therefore fair use.

I don't mind that the folks who own Atari's IP sent cease & desist letters to RedBubble; if I bought a collection of trademarks & copyrights I'd do the same. Most folks who buy these would already be Atari fans; the goods don't help create new fans; they compete against the products I'd hope to sell. Maybe if the works were given away at an expo I'd see it differently; at an expo new people would see them & ask what they were based on. But online? Only pre existing Atari fans will find them.

 

I will say that the basic shape of a console or controller probably isn't trademark-able; I know Convers wasn't able to trademark on the shape of their shoes. Using names, characters, & designs from a game is probably illegal.

 

Deleting everything tagged Atari... I thought tagging products Atari was fine, but I just reviewed: https://internetlaw.uslegal.com/online-business/general-legal-issues-confronting-those-starting-and-maintaining-an-online-business/metatags/and it looks like that was RedBubble's only option.

 

I still say Atari's owners should set up some sort of easy license scheme for fan works.

I'm positive all those counterfeit Where did you learn to fly? T-shirts are causing massive loss of revenue for Atari, jeopardizing their massive investment in Jaguar-related intellectual property.

You see?? It's the "should be able to run" line that makes me not really trust the new Ataribox VCS. For $300 plus extra for controllers, I want guarantees, not promises.

Can you re-upload them (perhaps with minute changes in case they 'scan' the file for previous versions) and just don't tag them with Atari?

 

Perhaps the fan-art community could come up with a new tag (Ex-Tari could be appropriate) and share the word with fans...sure, Atari or Redbubble might eventually figure it out, but it'd be fun to see how long the game could be played

RedBubble specifically state that if you reupload an artwork without permission it could get your entire store closed. I have made changes to artwork before (removed logos etc.) and that has been ok but in some cases (intellivision specifically) it wasn't enough and the new art got taken down too.
