If you have a valid receipt with a new product and pass it along, then that next owner would have a new game with a receipt of payment which proves ownership so then a warranty could be validated. Just saying it's new even if it really is and selling it privately may very well negate a warranty since the purchase wasn't yours in the first place and it can't be returned to you for a refund or (depending how it works) warranty process. Many warranties do require the original UPC, receipt, or some other tangible piece of evidence from a legitimate retailer. Me selling a sealed copy of Skyrim for Switch doesn't make me able to back a warranty replacement with a store receipt as ebay print outs won't cut it.
