Almost no homebrew gets permission. Usually the copyright holders either don't know they have the rights or don't care if a small run of games for a long dead system gets made. And usually the author tries to get permission in the first place. Personaly I'd like to see more original games instead of so many copyrighted ones, but I've heard argued that original homebrews just don't sell.
