I've been litigating cases for over 30 years and it is not straightforward. As a starter you need to determine if there are written terms that govern the deposit and if so, whether it can be orally modified. If there are no written terms its a whole different analysis. It's not straightforward. But with dollar amounts involved, nobody is suing.

it would be breach of contract if you could prove there is an actual contract. The 100% refundable statements could be used for punitive damages purposes. But in reality nobody is suing for $100. Also there is not going to be any class action as the potential recovery and ability to collect is not worth any lawyers time.

And that is why this typical IE (and TT) BS. Of course five years after announcing a console it is a part of their product strategy. As in strategy, plan, vision. But no clear statement like: the system is going to be released; or the system is not going to be released. No clear statement about what is being done to release it (engineers working on it, FCC testing, etc.) And remember in February 2022 Phil said he would announce a release date in the next couple of months. No release date in this update. Just the usual vague statement that the reader can interpret as they wish. Nothing different than what has been said for the last couple of year. And also, what about "100% guaranteed refunds?" That promise is not addressed either.

They are not pressing on. I read it as Amico games on other hardware platform. Amico deposit holders will have priority opportunity to get stuff from the "Amico Club List" [with no mention of when it will be live) which I would not be surprised if anyone can sign up for.

Why do people believe there was focus group testing in the traditional sense. I would not be surprise if TT considered "focus testing" to be gauging reactions and asking questions of friends, family, AA posters, live event people, etc. Which of course, is not real focus testing.

No as to FCC certifications complete. Anything else said on the subject is speculation not based on any first hand knowledge. Saying I read something posted by someone on the internet is not first hand knowledge. And unless one has been personally Involved obtaining FCC certs like kevtris, then it is just pure speculation as to say what the process is and what how one accomplishes it.

IE could have contracted out both the Design and Manufacturing of the Amico to Ark Electronics. Imagine how much could have been saved telling Ark this is the SOC, RAM, connectivity, features, form factor and have Ark design the PCB to manufacture. Instead they spent money on rent for multiple offices, employees and constant had a constant search for folks to design the Amico. @MrBeefy and others got so much grief from TT by simply repeating what he said. Remember the promise was not additional levels, graphics or couch co-op added, but rather "all original content made by some of the top developers in the world." No candy crush type rip offs. Original stuff not clones.

But the marketing hasn't started yet! (But we are on a retro forum telling everyone all the retro games that will be on it) You can't judge it until you've played it! (But it's ok to judge opine that it will be good) When reading the 3 threads in archive.org, it's obvious TT was just saying what folks wanted to hear, made ridiculous promises, and when caught in lies would either try to tell you black really is white, or just ignore and not respond. With insults sprinkled in (Saying the tells you its just a joke) Rinse and repeat, over and over again.

I'm starting to think the Amico threads are hidden to protect TT. Why, I don't know. Post below should have had a public announced thread ban and warning. Yet the users at AA saw nothing happen.
