  I'd say 3rd party for anyone but Atari themselves...2nd Party would be if Atari had bought another company who now make games for them, or maybe licensed some Activision games to put on a Flashback...

  It's all frame of reference however Flojo, If you're talking about game makers/devs/publishers (The Creators here),...That is different than talking about the Transaction (one Party sells The Second Party buys)...Obviously context is important.
