Ebay PC Game Lot auction not completely as described. What to do?

I won a 'lot' auction a while back, $68 shipped for 44 older vintage PC games (a lot of crap, some worth while).

 

Anyway, from the auction it states: "Huge assortment of PC CD Games. Many of the games are either boxed and/or sealed but all are in great working condition" I bolded what was messed up on a few of the games.

 

What really kinda ticket me off from the begin with was how HORRIBLE the items were shipped. They used these plastic bags (like stores use) as packing material?!? Uh yeah.. that didn't protect much if at all.

 

Anyway here's the break down of the 44 games:

37 games were as described.

3 games have a crap load of scratches. I'm not talking normal wear, these guys look like gonners (Sim City 2000, Civ II, Civ II Fantastic Worlds)

1 actually has a star crack on the plastic :( (Star Trek Starfleet Academy)

1 is listed as sealed, not even hardly, it's loose CD-Discs in sleaves, I'm assuming they just goofed in his listing (Riven)

1 is a MAC Game, DOH! (X-Wing Collector's CD-ROM)

1 is missing the install disk (X-Wing vs Tie Fighter Big Box). The game comes with 2 cds, a "Play" CD, and then a "Multi-Player" CD that you could give to a friend who then could install the crippled version and then you'd both be able to go at it over a phone line. Yeah, I only have the Multi-player disc.. DOH!

 

Normally if it was one thing or the other I'd be okay with it, but all these strikes (especially the last two games), and I've had it.

 

Any ideas on how to handle the situation?

Well, first I would suggest a link to the auction so we can see, in full, what was said for ourselves.

Ok, and you admit that 37 out of 44 are as described. Well, that's more then many. That's approaching most.

 

Now....

Have you actually tested them yet?

As per what you quoted from the auction, he didn't seem to name names of what was in what condition. Again, we need a link to the auction for this one.

Ok, well, we have atleast 2 out of 44 games confirmed to be not like the auction stated.

 

Maybe go ahead and bring it up with the seller. I doubt Ebay would do anything if you complained because by and large, it seems to me that you pretty much got what the auction basicly described. But again, without seeing the actual auction, it's hard to say with certainty.

Is the seller someone who usually sells PC games and knows a lot about this stuff, or is it a seller who had no idea what they were selling and doesn't know much about PC games?

99.1% positive feedback, so I doubt he's a scamming scumbag. Only a few negatives/neutrals.

 

Funny enough, the neutral I saw was a complaint similar to yours, and the sellers reply was:

 

"All our ads state that if dissatisfied with one of our items, please contact us."

 

So, there you go. Contact the seller regarding the couple of discrepancies you have and see what happens.
