any copyright issues with publishing new homebrew games?

seeing that some new homebrews are conversions of arcade games or other format, are there any copyright issues?

like LADY BUG and CONQUEST OF MARS, are the programmer or Atariage itself investigate first before releasing them?

how does it happen?

any precedent problems?
