Nintendo doesn't really seem to take down rom hacks and that's what this is... the creator of this hack is Kaze who is well known in the SM64 rom hacking scene. And since rom hacks are distributed using patch files rather than roms there's little chance of them being removed. In fact it were not for the rom hacking scene... Super Mario Maker would most likely not exist.

It works...kinda. I can get it to run of my Everdrive 64 v3, but it freezes at the end of World 1-1.

Now I see it. Its actually in the drop down arrow in the tile. Now I just have to figure out how to use bps files.
