Ebay removed my auction

I had an auction going for a NTSC TV Boy (near mint/mint shape with box and instructions)and Ebay cancelled it. It was at $120 with 2 hours left to go so I am bummed. Ebay sent me this:

 

Based on information supplied to eBay by Sony, Sega and/or Nintendo, the

following listing has been removed:

 

 

1285574788 NTSC TV BOY - Atari

 

All associated listing fees have been credited to your eBay account.

 

Your listing was removed because it offered to sell a potentially infringing

item. Your listing offered to sell potentially infringing copies of video

games, such as backup copies of games, unreleased games and/or “ROMS”. The sale

of such items potentially infringes the rights of the content owner and is not

allowed on eBay.

 

Has this happened to anybody else? What other Atari/classic items would fall under this category?

 

Well - I have an almost never used NTSC TV boy (plays 127 Atari games) with box and instructions and extra EPYX 500XJ joystick for good luck. This is not the common PAL format one so it works on any U.S. television. Any buyers? It is boxed and ready to go. E-mail at [email protected] or my AtariAge e-mail. I also have a list of all the games it plays. If you can't sell them on Ebay, they will be that much harder to buy .

In any case, what is their interest in the TV Boy? Neither Nintendo nor Sony made any 2600 games, though Sega did. Even if no Sega games are included in the TV Boy, I suppose a complainant might legitimately believe that the TV Boy infringes on its current rights to some intellectual property. (For hypothetical example, suppose the TV Boy includes Quadrun, and suppose Nintendo has licensed exclusive home video game rights to Quadrun.) Is there a legitimate case for Sony, Sega, “and/or” Nintendo to get involved on these grounds?

Yeah, that's pretty damn ridiculous. How much do you want to bet that a complaint wasn't even filed but that one of eBay's censors discovered it while looking through an automagically generated report of "questionable" items? You can bet that eBay has a large array of search terms they routinely search through all active auctions for. Sadly, "TV Boy" has probably made it to that list.

 

And yes, the DMCA is evil.

And yet another reason I will NEVER EVER sell anything on e-bay, EVER.

eBay does this once in a while... I'm sure it was just a filter going off after seeing the auction (You'd think they'd go off as soon as the auction is filed... perhaps someone told eBay that your auction was an act of piracy?). I really don't think it's fair to blame eBay though... they don't really know anything about this stuff, and they're actually forced by law to try to put a stop to things like this. I know it sucks, but it's not their fault.

 

Besides, this probably happens once for every 1000 or so auctions... I'd say that's a pretty good ratio.

Zero -- Should I wait and try to sell it again on Ebay? The note also says:

 

Our User Agreement provides that members may not offer items for sale that

infringe upon any third party's copyright or other proprietary rights. We

reserve the right to terminate any listing that offers infringing or illegal

goods for sale. We also reserve the right to terminate your account if you

continue to offer to sell goods that infringe another party's intellectual

property rights.

 

 

I don't want to lose my account, but I think it was just random bad luck like you said. Would you relist it later? -- RG

you know whats funny i play this online game called EverQuest and people sell there characters(account) that they built up or Items that they have got in the game on E-bay for alot of money and thats against the user agreement of the game

Hi, just my two cents here. Why don't you email the eBay people and ask them why did they cancel your auction. You are selling something perfectly legal. I'll bet it's just a mistake, or someone who complain with them for some reason (some people could be really weird) Email them, they'll email you back. I did that a couple of times with my own auctions and I always got an answer within hours. That's better than wondering

The item you were selling obviously violates intellectual property laws (the TV Boy never liscenced for those games to be included), so I'd say eBay did the right thing. I agree with the others, that it was probably just some automated fuction that erased the auction and sent you that e-mail, but this time it got it right.

 

Why is eBay so "evil"? Just because it doesn't allow you to sell illegal products on it?

I wouldn't. You might be better off trying a private auction or something. You won't get as wide an audience (Post it here or on rec.games.video.classic or something, and you'll get quite a few though I'm sure), but you won't have to worry about this.

 

You could try relisting it, but it's a little risky. I don't want to be blamed for getting anyone kicked off eBay

Re-list. Ebay has canceled 5-10 of my auctions (out of 1000-1500) before, they won't answer your e-mails, but they've never canceled the same auction twice on me. At least they refund all fee's and everything.

 

I would re-list it and keep track of the bidders, that way if ebay cancels it you can just e-mail the bidder and sell off of ebay.
