Jack's problem with Mortal Kombat Armageddon is Mortal Kombat: Armageddon contains an unauthorized commercial exploitation of my name, photograph, image, and likeness within the game.

 

The thing is Jack Thompson is not one of the 60 plus characters in the game. He got this from Judging from a photo of the game, Thompson is referring to a character made using the game's kreate-a-fighter mode.

 

Someone send him to buba now.

I don't know. After all, this fucktard has already played chicken with the ESRB and Rockstar games and won on a matter of creator unintended/player enabled content. After all, Rockstar pulled San Andreas and the ESRB rerated it based on content which could not be accessed without doing things to the software which were never intended.

 

Similarly, Marvel sued Cryptic software for creating a game where players might potentially use the character creator to create likenesses of Marvel characters like Captain America or Spider-Man. In that case, the parties settled out of court. So, there's no good legal precedent for this, only instances where the parties being accused flinched and made a deal. That may not be a good example for when something of this sort does finally go the distance in the courts.

I think the penny-arcade comic on that topic says it all though. It might not be copyright to have a guy with claws on his hands, but when those THREE claws rip out of his hands and go "schnitt!" chances are you wanted someone to make Wolverine.

Does it really offer Thompson's name in the character creation menu, or is that something that someone typed in? And if it was typed in, was it somebody at Midway or somebody else reviewing the game? These details could be factors determining who the judge would side with.

 

Whichever way, I can hear the announcer's voice now.

 

"Jack Thompson... wins. Technicality."

I think I will create a character with his likeness in Oblivion. The face creation software within the game will allow you to make a likeness of anyone you want. It has been around a while and nobody has gone after it (that I am aware of.) Maybe if we get him riled up about enough games he will be spread to thin to have any influence.

It's completely fan-made. It's no different from the character-creation modes in any other game (Soul Calibur 3, Tony Hawk, any sports or wrestling game, etc). The guy just has no sense of humour.

 

I remember when me and a friend used to spend hours making our bosses in WWF Wrestlemania 2000 on the N64... making them as close as possible in every way (with hilarious consequences). Heck, we spent far more time creating characters in that game than we ever spent actually playing it.

Dear lord, might as well take away paintbrushes since they could be used to create a likeness of this idiot. Whoops, pen and paper also, someone might copy down a passage from a book. Oh man, that piano needs to go--someone might play one of their favorite tunes on it without first seeking legal guidance! :roll:
