What would you do (Broken Neon from eBay)

Okay here's the deal. I bought an Xbox 360 and PS2 Neon sign from a seller on eBay. Their listings said $14 for shipping UPS. Come to find out he didn't mean to have UPS as an option... he only sends postal mail. Postal wanted $40 per sign. So I talk him into sending on my Fedex account. The signs come packed like a chimp did it... broken to all hell. The driver says it's the guys fault for poor packing but I still put in a claim, and they were honored for the basic insurance of $100 plus the shipping costs back. I took the signs to see if I could get them fixed, and the quote (because they have to make new letters) was $150 for one $135 for the other. So I'm thinking... hey I won the signs for less than that let's see if I can get another one of them on eBay... Low and behold the same guy is selling another PS2 (but not 360) sign with the same photo, and description. Mind you the first sign was new and mint (but broken). So I tell him I'll give him the exact amount of the insurance claim ($114) for the second sign if he sends it packed better, and makes it in one piece. Now mind you, the listing says the sign is NEW... the first was. So the sign comes today.. it isn't broken, it does work, but it is ancient. Dust, smoke, dim, WORN THE HELL OUT. Now I let him know what condition it was in BUT... I didn't make demands, ask for a discount or what have you. I'm waiting on a reply. I've already got a broken Xbox sign that will run $150 to fix or $179 free shipping to replace with a new one (all I got to cover that is the $100 plus shipping refund)... I'll be loosing money on that deal on the Xbox sign already. What would you do at this point? He hasn't been mean or grumpy, but I'd have to say he isn't very bright (sign pun).

I have read some of your E-Bay experiences and I have to say that you are beyond a doubt the most patient person that I have ever come across. I think you have every right to file a claim on this one. If the guy lists as new and sends you a "worn the hell out" p.o.s. AFTER he already sent you a broke piece of junk, you have already gone far and beyond the average buyer. Get your money back and send him back his crap.

My question is why would you buy from the same person twice if they gave you a horrible expierience and have shown that they are bassically scammers using stock photos and lying about the condition or packing it horribly.

 

 

Correction, I didn't buy from him twice. He had the only other PS2 sign up and I told him to get it here in one piece and THEN I'd pay him for it. As yet, I've not paid for the second PS2 sign.

The problem with that is... how does that make me better than him? Then I'm just a rip off like he is. If I return it I'm possibly dooming the sign to break, and paying $40 out of my pocket to do it. I can call the magical eBay number and get $137.52 back from them...

 

-$191.52 originally paid

$54.00 refunded for shipping

-$137.52 Actual cost of signs

 

-$31.00 paid for shipping

$114.00 refund from fedex

$117.00 refund from fedex

-$163.88 repair plus tax for xbox sign

-$115.00 agreed upon price for the next PS2 "NEW" sign

 

($216.40) Is what I finally pay for two signs worth ($137.52)

Forget that in this scenario the sign isn't new

and I've got to make a total of three cross

town trips to get the Xbox sign fixed

 

-$78.88 Is the loss

 

I think that if I tell the guy he gets $36.12 for the second sign he is going to be pissed off. That is what is fair, as I see it. eBay will probably give me all the money if I call them... and then they will take it out of his hide for me. If I got the $137.52 back from eBay gave the guy his $115 I would be getting paid $58.64 to take the signs and then eBay would deal with them directly. This seems like the action to take. I know there is no love for eBay but making them pay for it doesn't seem right... but it's in their court not mine, to make him pay for his poor service.

I have tried to get a few Neon signs and all 3 have arrived broke and all were packed great.I Did claim and was out nothing. It did take almost 30 days to get my money from post office. This was 3 years ago now.

You need to ask the guy for the best deal so he does not take a loss or you. That way both can walk away not to far set back from the entire deal with a lesson learned. In general all letters have to be remade on the sign unless its the clear glass that broke. First and last letter cost the most since they also have to add electroids to ends.

Damn... sorry to hear that Ax.

 

I have some anime statues I'd love to sell but I have no safe way of transporting them.

 

If you have a local Spencer's Gifts in your mall, look at their neon signs for sale. They manage to ship those without breaking. Maybe you could open one up and look at it to see how they package them safely.
